The latest amendment on the standard of construction brings significant changes to the handover of the works upon completion
An amendment to Law 10/1995 on the standard in construction came into force on following publication in the Official Gazette on May 9th.
Law 97/2019 instated a prohibition to transfer the right to use over a dwelling prior to the assessment of completion being achieved (in Romanian “admiterea receptiei”). Failure to comply with these provisions is sanctioned with a fine of RON 20,000 up to 40,000.
On May 14th, 2019, a legislative proposal further amending and supplementing the provisions of Law no. 10/1995 on quality in constructions was submitted to the Senate of Romania. This brings significant changes to the handover of the works upon completion.
Among other, the amendments regulate a further condition for the handover of the works at completion (in Romanian “admiterea receptiei”), namely the dwelling being connected to all public utility networks.
Another relevant amendment foresees that the handover of a building to the owner may be carried out only following the commissioning of authorized, appropriate and definitive connections to public utility networks. Failure to comply with these provisions is sanctioned with a fine of RON 20,000 up to 40,000.
