The latest amendment on the standard of construction brings significant changes to the handover of the works upon completion

An amendment to Law 10/1995 on the standards in construction came into force following its publication in the Official Gazette on 9 May 2019.

Law 97/2019 introduced a prohibition on the transfer of the right to use over a dwelling prior to the assessment of completion taking place (in Romanian “admiterea receptiei”). Failure to comply with these provisions is subject to sanction with a fine of between RON 20,000 and 40,000.

On 14 May 2019, a legislative proposal further amending and supplementing the provisions of Law no. 10/1995 on quality in constructions was submitted to the Senate of Romania. This brings significant changes to the handover of the works upon completion.

Amongst other things, the amendments seek to impose a further condition on the handover of the works at completion (in Romanian “admiterea receptiei”), namely the dwelling being connected to all public utility networks. It states that the handover of a building to the owner may only be carried out following the commissioning of authorised, appropriate and definitive connections to public utility networks. Failure to comply with these provisions is subject to sanction with a fine of between RON 20,000 and 40,000.
